Council for the Municipal District of Pincher Creek No. 9 met on Tuesday afternoon, September 25. In attendance were Reeve Terry Yagos and Councillors Bjorn Berg, Helen Cyr, and Rod Cyr, as well as CAO Wendy Kay, Development Officer Roland Milligan, Director of Operations Leo Reedyk, and Development Officer Assistant Tara Cryderman.
Burmis-Lundbreck Corridor Public Hearing
A Public Hearing will be held on Tuesday, October 9 at 6:30 pm at the Municipal District Administration Building regarding Bylaw 1228-12, known as the Burmis-Lundbreck Corridor Area Structure Plan.
Agricultural Fieldman appointed
Shane Poulsen has accepted an appointment as Agricultural Fieldman for the Municipal District of Pincher Creek No. 9.
Foundation contract awarded for new MD Building
Council unanimously agreed to award the foundation work subcontract for the new MD administration building to AGRA Foundations Limited. The 2-story, 17,000 foot building will be built on MD land at the corner of Waterton Avenue and Macleod Street, Pincher Creek. Scott Construction (Alberta) Ltd. was previously awarded the contract for Construction Management services and made a recommendation to accept the AGRA bid, in the amount of $151,218.
Notices of Conservation Easement
Reeve Terry Yagos excused himself from council chambers for conflict of interest reasons as council discussed a Notice Prior to Registration of Conservation Easement that applied to his own property.
The Notice Prior to Registration says, in part, the purpose of the easement is "for the purpose of the protection, conservation and enhancement of the Conservation Values of the Property", citing the "ecological, scenic, aesthetic, and open space values of the Property, including flora, fauna, wetlands and soils". The parcel in question is near Lee Lake.
Development Officer Roland Milligan told council that the notice was standard practice, and that while the MD could register an objection "the easement may still be registered". "It's just nice to have our consent," he said. He recommended council acknowledge the notice and waive the 60-day notice required prior to registration, which they did.
A similar Notice of Conservation Easement for a small parcel of land owned by the Leskosky family got the approval of council as well.

Revisiting Road Closure Bylaw
A road closure bylaw that passed first reading, received a public hearing, and stalled when Alberta Transportation rejected it and Council could not find a solution that was acceptable to a majority of councillors at their September 10 meeting was revisited at this meeting.

Council documents state one adjoining landowner had expressed "strong concerns" at the Public Hearing held on May 10, 2012.
A new bylaw was prepared (1230-12) with wording that Alberta Transportation based its objection on removed.
Councillor Bjorn Berg expressed concerns about the way Alberta Transportation has handled the matter. "It's my view that we should ask Alberta Transportation in to talk to council to see what their policy is going to be about road closures. We've never had any other advisor from Alberta Transportation do this."
I want to table this until we get this individual here," Berg concluded, before making a motion to that effect, which passed unanimously.
MD Council agrees to new Joint Funding contract with the Town of Pincher Creek
Council unanimously agreed to contribute $30.00 per capita annually for Joint Funding projects with the Town of Pincher Creek, who will also contribute $30.00 per capita annually.
Raises for Reeve and Councillors deferred by a year
According to Council documents, "Earlier this year Council appointed three people to sit on a Council Renumeration Committee, to review current rated paid to Council for their service to the community.
That committee recommended renumerative raises of $50 to commence this year on November 1, with additional raises of $50 every November up to and including the year 2015.
Councillor Bjorn Berg suggested the raises be deferred until next year, which council unanimously agreed to.

The Reeve will recieve a $50 raise on November 1, 2013 to $600.00.
