Notes from August 25, 2014 meeting of Pincher Creek Town Council

Council for the Town of Pincher Creek met on the evening of August 25, 2014. In attendance were Mayor Don Anderberg and Councillors Adrian Hartman, Wayne Elliott, Mark Barber, Tammy Rubbelke, Lorne Jackson, and Doug Thornton. CAO Laurie Wilgosh and Oldman River Regional Services Commission Planner Ryan Dyck were also in attendance.


Proposed Turcott/Bank of Commerce addition to KBPV discussed again at Town Council meeting

The Pincher Creek and District Historical Society (PCDHS) has been planning to add the 110 year-old Turcott/Bank of Commerce building to the Kootenai Brown Pioneer Village (KBPV) collection. The first proposed location was received with much displeasure from some of those who live close to the museum, who indicated their position at a Town Council meeting held July 28, 2014.



Trevor Birkmann talks business with Town Council

On Monday August 26, citizen Trevor Birkmann appeared before Pincher Creek's Town Council as a delegation in order to discuss business in Pincher Creek. Birkmann is a former member of Council.  He said he recently he toured the town and became aware of a growing issues. 


Land Use Bylaw amendments: Bylaw 1547 T, U, and V

The meeting opened with a scheduled public hearing for Land Use Bylaw amendments for Bylaw 1547. The areas that were to be amended included T, U, and V. For all three of these amendments, CAO Laurie Wilgosh said that there was no correspondence, phone calls, or concerns presented from either the public, the departments of the Bylaw Officer, The Town Operations Department, or Emergency Services. No one came forward during the hearing to voice any concerns. Later in the same meeting these bylaws were discussed.

1547-T amendment changed the wording pertaining to retaining walls, grading and drainage from "The Municipal Development and Subdivision Authority or Designated officer shall require..." to "The Municipal Development and Subdivision Authority or Designated officer may require...". This bylaw went through second reading. During this reading Oldman River Regional Services Commission (ORRSC) Planner Ryan Dyck spoke to this change. "Now we are inserting this discretionary measure, and how is one to exercise that discretion?" He offered to add input to clarify the amendment. Councillor Doug Thornton removed himself from the room during this session due to pecuniary interests.

1547-U amendment was to change a land use district to Business Park - 13 to accommodate a variety of compatible commercial, light industrial, recreational, public and institutional uses in the business park. This bylaw went through second and third and final reading.

1547-V amendment was to change a land use district area in the northeast industrial area from Light Industrial 12 to Business Park - 13 to accommodate a variety of compatible commercial, light industrial, recreational, public and institutional uses in the business park. The affected area includes several blocks north of Highway 6 to Table Mountain Street. This bylaw went through second and third and final reading.

Budgets approved for aesthetic improvement 

Council unanimously voted to increase the capital budget for two projects. The first was landscaping around the RCMP detachment building, that will have a budget increase of $20,000 for landscaping and irrigation. Previous to this time they had tried to use a zero landscaping measure, but it  has been found to be difficult to maintain. The second is a $50,000 budget to improve and upgrade signage throughout the Town of Pincher Creek. Both of these will be funded from the budget surplus reserve account.

Signing authority assigned to positions, rather than people

Council for the Town of Pincher Creek gave first reading to a revised signing authority bylaw #1567-14. CAO Laurie Wilgosh explained, "We had a bylaw that designated the CAO, the Finance Officer and the Manager of Legislative Services, and also the Mayor and Deputy Mayor as signing authorities, but at every organization meeting we would designate one of the council members, also." This will allow for the signing authority to go be assigned to a position, rather than a person so whoever is in that position will automatically have signing authority. Administration indicated this will streamline the process and eliminate the need for having a new motion when a specific person is no longer acting for the Town of Pincher Creek.

AUMA planning discussed

The 2014 Alberta Urban Municipalities Association (AUMA) Convention that is scheduled to be held September 22 - 26 was discussed. Councillor Tammy Rubbelke and Councillor Wayne Elliott expressed an interest in attending some of the pre-conference sessions and education opportunities. Council directed administration to schedule meet with the following government departments during the convention:

  • RCMP K Division - For discussion of establishing a police committee in Pincher Creek
  • Alberta Transportation - for better understanding of Highway 3 twinning and location of interchange
  • Minister of Municipal Affairs, Housing - to discuss senior and community housing
  • Provincial Parks - Possible improvements


Councillors were asked to prepare questions for these departments, and inform administration if there were additional departments that they wanted to have a scheduled meeting with.

Due to the AUMA conference the regular Council meeting on Monday, September 22 has been rescheduled to Monday, September 29.

Chinook Arch budget approved

Chinook Arch Regional Library System has presented to Town of Pincher Creek Council a 4 year budget. This budget is for 2015-2018 and includes a 3% increase to the municipal levies per capita for each of the four years.

This will result in an $0.86 per capita increase at the current population by 2018. In 2014 the Town of Pincher Creek contributed $25,296.81, and is projected to increase by $3,112.34 by 2018 if the population remains the same. the Library Board Fee is to remain the same for the four years.

After the public session of the meeting council went in camera to discuss land, legal and labour issues.
